These Website Terms and Conditions (“Terms”) govern access to and use of defender-storage.com, related online account functions, and the portions of the 6Storage platform and mobile application made available for Defender Storage services (collectively, the “Site”). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. Company and Contact Information

The Site is operated for Defender Management, LLC, doing business as Defender Storage (“Defender Storage,” “we,” “us,” or “our”). Our mailing address is PO Box 1254, Argyle, Texas 76226. Our facility is located at 8137 FM 1902, Joshua, Texas 76058. Contact us at 817-935-8371 or contact@defender-storage.com.

2. Eligibility

You must be at least 18 years old and legally capable of entering a binding agreement to use rental or account functions on the Site. Rentals are offered only for the Defender Storage facility in Texas. A prospective tenant must be an existing Defender Outdoors, LLC customer and must satisfy Defender Storage’s rental requirements. We may verify eligibility before completing a rental.

3. Website Terms Versus Rental Agreement

These Terms govern the Site. The storage lease or rental agreement, recurring-payment authorization, tenant protection addendum, facility rules, and other documents accepted during the rental process govern the rental relationship and use of the facility or unit (collectively, the “Rental Documents”). If these Terms conflict with Rental Documents concerning a rental, the Rental Documents control. Nothing on the Site modifies a signed Rental Document unless the modification is expressly made in a written agreement authorized by Defender Storage.

4. Rentals, Availability, and Possession

Defender Storage does not accept advance reservations, hold units, or collect reservation or holding fees. Lease execution, payment of rent and the administrative fee, and delivery of possession or access occur as part of the same rental transaction. Display of a unit, price, or feature does not guarantee availability until the rental transaction is completed.

You are responsible for confirming that the selected unit is suitable for the approved vehicle and for providing complete and accurate rental, vehicle, coverage, payment, and authorized-person information. Rental prices, taxes, administrative fees, and other charges are shown during the transaction or stated in the Rental Documents.

5. Required Coverage and Tenant Protection

Tenants must maintain qualifying coverage throughout the rental term as required by the Rental Documents. For purposes of Defender Storage’s rental requirements, this obligation may be satisfied by the tenant’s own qualifying liability insurance, enrollment in the accepted 6Storage Tenant Protection Plan, or both. Enrollment in the 6Storage plan is not required when the tenant maintains satisfactory qualifying independent coverage.

Any tenant protection plan is governed by its separate addendum, fees, coverage limits, exclusions, claim procedures, cancellation provisions, and other plan terms. Those plan terms control if they conflict with a general description on the Site. Site content is not a guarantee that a particular loss, vehicle, item, event, or claim will be covered.

6. Accounts, Credentials, and Mobile Access

You are responsible for maintaining the confidentiality of usernames, passwords, access codes, devices, and other credentials associated with your account or facility access. You may not share credentials or permit unauthorized persons to use your account or access the facility. Notify Defender Storage promptly if credentials or devices are lost, stolen, compromised, or used without authorization.

Mobile and digital access features may depend on compatible devices, connectivity, third-party platforms, and facility operating conditions. Access rights remain subject to the Rental Documents, account status, facility rules, and security requirements.

7. Payments and Refunds

Payments are processed through Fortis and related financial institutions. By submitting a payment method or accepting a payment authorization, you authorize the transactions described during checkout and in the applicable Rental Documents. You are responsible for maintaining accurate payment information and for charges, taxes, fees, interest, and other amounts due under those documents.

Refunds are governed by the Defender Storage Refund Policy and applicable Rental Documents. The $50 administrative fee is nonrefundable. Rent is not refunded or prorated because of tenant-initiated cancellation, early termination, or early move-out, including when annual rent has been prepaid, except as expressly stated in the Refund Policy, Rental Documents, or applicable law.

8. Electronic Transactions and Communications

You consent to conduct Site transactions electronically and to receive agreements, disclosures, receipts, notices, and records electronically at the email address or through the account you provide, subject to applicable law and the Rental Documents. You are responsible for maintaining a valid email address and the hardware and software needed to access electronic records.

Defender Storage does not currently use automated marketing texts or robocalls for tenant communications. Standard telephone, email, mobile-application, and account communications may be used for customer service, security, access, payments, coverage, leases, and other operational purposes.

9. Acceptable Use

You agree not to:

  • Use the Site for unlawful, fraudulent, deceptive, abusive, or unauthorized purposes.
  • Provide false information, impersonate another person, misrepresent eligibility, or attempt to rent property you are not authorized to store.
  • Access or attempt to access another person’s account, credentials, payment information, access code, or nonpublic system.
  • Interfere with Site operation or security, introduce malicious code, probe or bypass security controls, overload the Site, or conduct automated scraping without written permission.
  • Copy, modify, distribute, reverse engineer, frame, or commercially exploit Site content or software except as expressly permitted by law or written authorization.
  • Use the Site in a way that infringes intellectual-property, privacy, publicity, contractual, or other rights.

10. Privacy

Our Privacy Policy explains how personal information is collected, used, disclosed, retained, and protected. By using the Site, you acknowledge that information will be handled as described in the Privacy Policy and the applicable notices of third-party providers.

11. Third-Party Services

The Site relies on third-party technology and services, including 6Storage, Fortis, Google Analytics, Google reCAPTCHA, mobile platforms, communications providers, financial institutions, and tenant protection providers. Third-party services may be governed by separate terms and privacy notices. Defender Storage does not control unaffiliated third-party systems and is not responsible for their independent acts or omissions, except to the extent responsibility cannot lawfully be excluded.

12. Intellectual Property

The Site, its Defender Storage content, trademarks, service marks, branding, text, images, graphics, arrangement, and other materials are owned by or licensed to Defender Storage and are protected by applicable law. Software, platform components, and other materials provided by 6Storage or other licensors remain the property of their respective owners. Subject to these Terms, you receive a limited, revocable, nonexclusive, nontransferable right to use the Site for personal rental and account purposes.

13. Site Availability and Disclaimers

THE SITE AND ITS CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS TO THE FULLEST EXTENT PERMITTED BY LAW. DEFENDER STORAGE DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR AVAILABLE AT ALL TIMES, OR THAT SITE CONTENT WILL BE COMPLETE OR SUITABLE FOR EVERY PURPOSE.

Site descriptions do not constitute warranties concerning the safety, security, condition, suitability, or protection of any unit, facility, vehicle, or stored property. Those matters are governed by the Rental Documents. Nothing in these Terms excludes an express obligation contained in a signed Rental Document or a right that cannot lawfully be waived.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, DEFENDER STORAGE AND ITS MEMBERS, MANAGERS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING SOLELY FROM USE OF OR INABILITY TO USE THE SITE, INCLUDING LOSS OF DATA, PROFITS, BUSINESS OPPORTUNITY, OR USE, EVEN IF ADVISED THAT SUCH DAMAGES MAY OCCUR.

This Section applies to Site-related claims and does not replace the allocation of risk in applicable Rental Documents. It does not limit liability for gross negligence, willful misconduct, or any liability that cannot be limited under applicable law.

15. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Defender Storage and its members, managers, employees, agents, and affiliates from third-party claims, losses, liabilities, and reasonable costs arising from your unlawful or unauthorized Site use, violation of these Terms, infringement of another person’s rights, or fraudulent information or activity. This obligation does not apply to the extent a claim results from Defender Storage’s gross negligence or willful misconduct.

16. Suspension and Termination

We may restrict or suspend Site, account, or digital-access functions when reasonably necessary to protect security, investigate misuse, comply with law, address a breach, or enforce applicable agreements. Suspension of a Site account does not cancel payment or other obligations under Rental Documents. Facility access and rental termination remain governed by those documents and applicable law.

17. Governing Law and Disputes

Texas law governs these Terms without regard to conflict-of-laws principles. A dispute arising from or relating to a rental or Rental Document is governed by the dispute-resolution, arbitration, governing-law, and venue provisions in the applicable Rental Document. Any Site dispute not governed by a Rental Document must be brought exclusively in a state or federal court of competent jurisdiction located in Johnson County, Texas, and each party consents to that jurisdiction and venue.

18. Changes to These Terms

We may update these Terms by posting a revised version with an updated date. Changes apply prospectively when posted or as otherwise stated. Material changes affecting an existing rental will not amend signed Rental Documents unless made in accordance with those documents and applicable law.

19. General Terms

If a provision of these Terms is held invalid or unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver. You may not assign Site rights or obligations without our written consent. We may assign these Terms in connection with an affiliate transaction, financing, sale, merger, reorganization, or transfer of the Site or business. Headings are for convenience only.
